{"id":165014,"date":"2026-05-08T17:14:28","date_gmt":"2026-05-08T15:14:28","guid":{"rendered":"https:\/\/nupsaw.org.za\/?p=165014"},"modified":"2026-05-08T17:14:28","modified_gmt":"2026-05-08T15:14:28","slug":"nupsaw-welcomes-the-concourt-ruling-on-the-phala-phala-scandal","status":"publish","type":"post","link":"https:\/\/nupsaw.org.za\/index.php\/2026\/05\/08\/nupsaw-welcomes-the-concourt-ruling-on-the-phala-phala-scandal\/","title":{"rendered":"NUPSAW welcomes the ConCourt ruling on the Phala Phala scandal"},"content":{"rendered":"<p><strong>NUPSAW welcomes the ConCourt ruling on the Phala Phala scandal<\/strong><\/p>\n<p><strong>\u00a0<\/strong>National Union of Public Service and Allied Workers (NUPSAW) welcomes the ruling by the Constitutional Court (ConCourt) of South Africa that the National Assembly vote in December 2022 was unconstitutional. The vote rejected the recommendation that the report by the independent Phala Phala panel be referred to an impeachment committee. This move by the National Assembly protected President Cyril Ramaphosa from being held accountable for his unconstitutional actions.<\/p>\n<p>The Phala Phala scandal dates back to February 2020, when a large amount of foreign currency was stolen at the Limpopo game Farm belonging to President Ramaphosa. This scandal exposed lack of accountability by the country\u2019s leaders and their disregard for the laws governing this very country, which was a huge oversight on their part as they are the ones who are supposed to enforce those laws.<\/p>\n<p>NUPSAW believes that the ruling by the ConCourt is a clear indication that no one is above the law and that the leaders cannot hide their criminal activity behind their positions. It further exposed the interference of institutions of democracy that were adamant to shield the President and sweep the whole thing under the rug. The role played by the Public Protector, the South African Reserve Bank and other institutions that cleared the President of any wrongdoing, is a clear indication that they put the interest of the elite politicians ahead of upholding the constitution. They too need to be held accountable for disregarding the rule of law and face any disciplinary measures suitable for this atrocity. This union in the same breath, notes and applauds those who had the courage to vote in favour of the constitution and not the \u201cBlue Lights\u201d to ensure that the President is held accountable. This is evidence of true and principled leadership.<\/p>\n<p>We therefore call on the resignation of President Ramaphosa and swift action to ensure the implementation of the Court order. The people of this country deserve a leader that respects the rule of law and adheres to the very Constitution that they preach about daily.<\/p>\n<p>Under the leadership of President Ramaphosa, this country\u2019s economy has collapsed, Ministers are not performing their functions diligently, corruption is at its peak and service delivery is non-existent. The ordinary citizens are suffering daily while the leaders that are supposed to bring a better life are continuing to enrich themselves and using their power to evade the law. The \u201cdemocratic\u201d South Africa we are supposed to be living in is nothing but a dream. It is high time the President is held accountable for the rot he represents.<\/p>\n<p>NUPSAW further calls on the leaders of this country to act in a constitutional manner that aims to build the country and create better living conditions for the working class and the poor communities. We will not sit idle and watch the laws of this country molded to suit and shield politicians.
