The National Union of Public Service and Allied Workers (NUPSAW) got the court order in their favour on the matter regarding exclusion in of Public Health and Social Development Sectoral Bargaining Council (PHSDSBC) that the National Department of Health and National Department of Social Development furnish the General Secretary of PHSDSBC with an unqualified list of NUPSAW members within the Department of Public Health and Social Development for whom the persal deductions are effected by the employer.
The threshold within the council is currently sitting at 30 000, and on 12 August 2019, NUPSAW submitted their audited membership as per settlement agreement in the council of 33 351 and the employer submitted two persal reports of 20 075 and another of 13 225. The employer suggested that 13 225 are abnormal appointed personnel and they do not belong to the bargaining councils.
In light of the above, this is victory for NUPSAW in that the employer is ordered by the Labour Court to furnish NUPSAW with an unqualified list of its members and also for the General Secretary of PHSDSBC to convene a council meeting within 14 days to consider the re-application of NUPSAW in PHSDSBC.
